VCCI Continues Seeking Suggestions from Enterprises

“It is necessary to continue collecting the business community’s opinions via the Vietnam Chamber of Commerce and Industry (VCCI), on projects and draft laws related to business activities and enterprises’ business rights under Decree No. 161/2005/ND-CP. This will ensure equality for subject groups stipulated in other legal documents”, said Tran Huu Huynh, Head of VCCI Legal Department.
 
The VCCI issued Document No. 0151/PTM-PC to seek enterprises’ opinions in the decree guiding the law on promulgation of legal documents for submission to the government. Why is it necessary to collect the business community’s opinions through the VCCI while there is no same regulation for other subjects?
It is because we have a large number of business legal documents. Besides, this is important to build Vietnam’s socialist-oriented market economy of the model of state, society and enterprises. It is also a condition for other subjects to raise their voice in the harmonious relation with businesses. Furthermore, the process is a key factor to implement effectively regulations on seeking public opinions on draft legal documents to serve the country’s development. In addition, the process matches international real condition and practices.
 
What is the most important in the process?
The most important is specifying duty of drafting boards and the VCCI in seeking opinions from different firms and business associations.
 
Additionally, one of other essential contents of the process is subject groups’ rights to raise their voice in the relation with enterprises.
 
In reality, the VCCI is responsible for combine enterprises’ suggestions with related ones such as research experts, scientists, activists and lawyers in order to hamornise their interests. Therefore, the suggestions that the VCCI summits to drafting boards is the business community’s opinions.
 
With experience of world and regional countries, what will the process bring businesses?
Many foreign countries pay attention to enterprises in the process of seeking public opinions for draft legal documents. Moreover, in many countries, Regulatory Impacts Assessment (when the documents have just been drafted and Regulatory Impacts Evaluasion – RIE (when the documents have been approved and implemented) are based on suggestions of impacted subject groups, mainly businesses. The business legal documents are important and greatly influence a country’s socio-economic and political situation.
 
Currently, in Vietnam, legal documents directly or indirectly involve in business activities also account for the majority in the country’s legal document system. If they are carefully complied and based on the reality, they will have long and direct influences on business activities as well as several sectors’ development, even the whole economy. They also bring chain impacts on other groups of labourers and consumers.
 
In the coming time, we will propose the government to issue a document to instruct the process of RIE after the documents is executed.
 
The Government Office has promulgated a dispatch No. 1079/VPCP-PL to transmit the Prime Minister on regulations on collecting enterprises’ opinions via the VCCI. Accordingly, the PM will allow the VCCI to carry out this under Article 27 of Decree No. 161/2005/ND-CP enacted on December 27, 2005.
